By accessing or using PAnellie, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Introduction
Welcome to PAnellie ("we", "us", "our"). PAnellie is an online clinical management platform tailored for allied health professionals. These Terms and Conditions ("Terms") govern your access and use of our services including our web application, mobile app, APIs, and any other products or services provided (collectively, the "Services").
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use our Services. You represent and warrant that you meet these requirements.
3. Accounts
You must register and maintain a user account to access most features.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to notify us immediately of any unauthorized use of your account.
4. Use of Services
You agree to use PAnellie only for lawful purposes, including:
Managing client data and clinical notes in compliance with Australian privacy legislation (including the Privacy Act 1988 and NDIS Practice Standards).
Using AI-generated notes and billing features ethically and with client consent.
Not misusing the platform, attempting to reverse engineer, or attempting to gain unauthorized access.
5. Privacy and Data Security
Your use of the platform is subject to our Privacy Policy. We adhere to the Australian Privacy Principles (APPs) and, where applicable, international privacy laws such as the GDPR and HIPAA.
You retain ownership of all client data. We will not access, disclose, or sell your data, except:
With your consent;
As required by law;
To comply with regulatory authorities.
6. Subscription & Payment
PAnellie operates on a subscription model. By subscribing, you agree to pay all applicable fees in accordance with your selected plan.
All prices are in AUD and include GST unless stated otherwise.
Payments are processed monthly in advance.
Failure to make payment may result in suspension or termination of services.
Refund Policy: We do not offer refunds for partial use or unused periods. A 14-day free trial is provided for all new customers.
7. Intellectual Property
All intellectual property in the platform, including design, layout, code, branding, trademarks, and AI functionality, are owned by PAnellie or its licensors.
You may not:
Copy, reproduce, or distribute any part of the platform without written permission.
Use the branding or logo in any misleading way.
8. Client Content & Clinical Data
You are solely responsible for all information entered into PAnellie, including:
Clinical notes
Client files
Uploaded templates and documents
You must ensure all client information complies with local laws and sector standards (e.g., AHPRA, NDIS, Medicare).
9. Limitation of Liability
To the extent permitted by law:
PAnellie shall not be liable for indirect, incidental, special, or consequential damages.
Our liability for breach of any term is limited to the re-supply of the Services or refund of the amount paid (up to the last 12 months).
You agree that AI-generated notes are for support only and that clinical responsibility remains with the user.
10. Termination
We may suspend or terminate your access if:
You breach these Terms;
You fail to make timely payments;
You misuse or attempt to exploit the platform.
You may terminate your subscription at any time via your account settings. Termination does not relieve you of any outstanding payment obligations.
11. Changes to Terms
We may update these Terms from time to time. If material changes are made, we will notify you via email or in-app message. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. All disputes will be resolved in the courts of New South Wales unless international jurisdiction is more appropriate.
13. International Use
PAnellie may be accessed from other countries. You are responsible for compliance with local laws, including health data handling regulations.
